1. Introduction

These Terms & Conditions ("Terms") govern your use of the Goawala platform ("Platform"), operated by SAHAJA YATRA VENTURES LLP (LLP Identification No: ACF-4815), a limited liability partnership registered under the laws of India, with its registered office in Goa, India ("Company", "we", "us", or "our").

By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, please do not use the Platform.

2. Definitions

  • "Platform" refers to the Goawala website, mobile applications, and all related services.
  • "User" refers to any individual or entity that accesses or uses the Platform.
  • "Operator" refers to third-party tour and activity providers listed on the Platform.
  • "Booking" refers to a reservation made through the Platform for an activity or tour.

3. Eligibility

You must be at least 18 years of age to use the Platform. By using the Platform, you represent and warrant that you meet this age requirement and have the legal capacity to enter into a binding agreement.

4. Account Registration

Certain features of the Platform may require you to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

5. Bookings and Payments

  • All bookings are subject to availability and confirmation by the respective Operator.
  • Prices displayed on the Platform are in Indian Rupees (INR) and include applicable taxes unless otherwise stated.
  • Payments are processed through secure third-party payment gateways (Razorpay). We do not store your payment card details.
  • A booking is confirmed only after successful payment and confirmation notification.

6. Cancellation and Refunds

Cancellation and refund policies vary by Operator and activity. Please refer to the specific activity listing and our Refund & Cancellation Policy for details.

7. User Obligations

You agree to:

  • Provide accurate and complete information when making bookings.
  • Comply with all applicable laws and regulations while using the Platform.
  • Not misuse the Platform for any unlawful or unauthorised purpose.
  • Not attempt to gain unauthorised access to any part of the Platform.

8. Intellectual Property

All content on the Platform, including text, graphics, logos, images, and software, is the property of SAHAJA YATRA VENTURES LLP or its licensors and is protected by intellectual property laws. You may not reproduce, distribute, or create derivative works without our prior written consent.

9. Limitation of Liability

Goawala acts as an intermediary between Users and Operators. We are not liable for:

  • The quality, safety, or legality of activities offered by Operators.
  • Any injury, loss, or damage arising from participation in activities.
  • Any delays, cancellations, or changes made by Operators.

Our total liability to you shall not exceed the amount paid by you for the specific booking in question.

10. Indemnification

You agree to indemnify and hold harmless SAHAJA YATRA VENTURES LLP, its partners, employees, and affiliates from any claims, losses, or damages arising from your use of the Platform or violation of these Terms.

11. Modifications

We reserve the right to modify these Terms at any time. Changes will be effective upon posting on the Platform. Your continued use of the Platform after changes constitutes acceptance of the modified Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in Panaji, Goa.
